SAFETYCARE- TERMS & CONDITIONS
- Safetyhub is an annual subscription service provided by Safetycare Australia Pty Ltd Safetycare Inc, Safetycare (UK) Ltd, (Safetycare) that allows users access to digital media files of Safetycare video programs (Services).

- Safetycare owns and operates the Safetycare website made available at https://www.safetyhub.com together with Safetyhub (together referred to as the Platform).
- These Terms & Conditions govern your access to and use of the Platform. By using the Platform, you are agreeing to the Terms & Conditions, as may be updated from time to time. If we make a change to the Terms & Conditions, the revised version will be posted on our website. We will post a notice on our Platform to notify you of any significant changes to our Terms & Conditions and indicate at the end of the Terms & Conditions when it was most recently updated. It is your responsibility, and we encourage you, to check the Platform from time to time in order to determine whether there have been any changes.
- You acknowledge that we retain exclusive ownership and control of the intellectual property rights in all software and content made available to you on the Platform. Apart from any fair dealing for the purpose of private study, research, criticism or review as permitted under copyright law, no part of the training material contained in Safetyhub may be reproduced by any process without the prior written permission of
- The information contained in Safetyhub is distributed and sold as a guide and for information purposes Safetycare makes no representation or warranty as to the compliance or suitability of the information with any and all applicable laws of the user’s jurisdiction nor as to the accuracy or reliability of such information. Safetycare will not be responsible for any direct, indirect or consequential damage or loss of profits, even if Safetycare has been advised of the possibility of such damage.
- You must:
- ensure that any information you provide to us is true, accurate and complete;
- promptly follow all directions from us in respect to your conduct in connection with the Platform;
- comply with all applicable laws and regulations when using the Platform; and
- bear all costs and expenses related to your use of the Platform.
- You must not:
- misuse the Platform;
- use the Platform in a way that violates applicable laws, that violates the intellectual property rights or other rights of us or others, or that is fraudulent, obscene, unprofessional, offensive, misleading or defamatory; or
- post reviews or commentary to promulgate deceptive or offensive or extreme opinions or any other illegal, malicious or deceptive activities.
- If you breach paragraph 7 or 8 of these Terms & Conditions, we reserve the right to report any such breach to the relevant authorities and disclose your identity to them. In addition, Safetycare reserves the right to suspend or terminate your access to the Platform at our sole discretion without notice.
- In consideration for the provision of the Services, you must pay us the fees as requested by us. We retain the right to vary our fees from time to time. Subject to the terms of these Terms & Conditions, any fees paid are strictly nonrefundable.
- Safetyhub will not be activated until payment for the service has been received.
- Where any statute implies any term, condition or warranty and that statute avoids or prohibits provisions excluding or modifying the application of or exercise of or liability under such term, condition or warranty, then that term, condition or warranty is deemed to be included in these conditions of sale. However, the liability of Safetycare for any breach of such term, condition or warranty will be limited to the amount paid by the user (if any).
- As the Safetyhub subscription service is partly dependent upon the reliability of the user’s internet service provider, Safetycare cannot be held liable for delays or disruptions caused by the user’s provider. Safetycare is also partly dependent on an internet service provider. From time to time there may be short delays caused by Safetycare’s service provider effecting delivery of the Safetyhub service. If the user’s use of Safetyhub is disrupted by Safetycare’s service provider for a continuous period of 5 working days or more, the lost time will be added to the end of the subscription period or a pro-rata refund will be made by Safetycare for the lost time of the subscription period. Safetycare must be informed in writing of the disruption within two weeks of the disruption and agree that the cause of disruption was a result of Safetycare’s service provider before Safetycare will add time to the subscription period or make a pro-rata refund.
- Safetycare reserves the right to replace, add, change or remove video programs (digital media files) available to Safetyhub users at any time.
- Safetyhub is to be used only by the Organisation, Corporation, Institution, Business or Person who has purchased the product and used only in the manner as reflected by the subscription agreement that was entered into at the time of purchase.
- Our Privacy Policy which sets out how we will use your information can be found at https://www.safetyhub.com/en-gb/privacy-policy/ By using the Platform, you consent to the processing described under the privacy policy and warrant that all data provided by you is accurate.
- These Terms & Conditions and any contract to which they apply shall be governed by the laws of New South Wales and are subject to the jurisdiction of the courts of New South Wales.
